Furthermore, if you travel across state lines into Florida while you are in possession of an illegal drug, you may also be charged with trafficking. The drugs involved can include any of those listed as “controlled substances” under state or federal law, including unauthorized prescription drugs such as painkillers, and more.

How you will be charged when found with illegal drugs is primarily dependent on the type of drug and its amount in your possession or under your control. For example, drug trafficking charges involving over 400 grams of cocaine would be considered more serious than trafficking 30 pounds of marijuana.
If you are found in possession of a firearm or weapon when arrested for drug trafficking, you will also face the charge of “armed trafficking.” This will likely increase your penalties even more. Depending on the circumstances, you may be facing minimum mandatory sentencing.
What are the Penalties for Drug Trafficking Convictions in Florida?
The penalties you will face in any drug trafficking conviction will depend on if your case was prosecuted at the state or federal level. Federal drug charges are generally more serious than those at the state level. However, even at the state level, you will face mandatory minimum sentencing.
For example, under state law trafficking in 25 up to 2,000 pounds of marijuana or 28 up to 200 grams of cocaine is punishable by three years in prison and a fine of up to $25,000. Trafficking in four up to 14 grams of heroin is punishable by three years in prison and a fine of up to $50,000. In drug trafficking charges, prison terms can range up to 25 years while fines can range up to $500,000, depending on the type of drug and the quantity. All drug trafficking is charged as first-degree felonies in Florida. Federal penalties can be even harsher and will increase even further in the case of prior convictions.
