Drug cultivation and manufacturing are two very different crimes, but they are both defined in the same way under Florida law. Both of these offenses are considered drug crimes.

State law defines drug cultivation as the planting, growing, or harvesting of any kind of plant that produces a controlled substance. On the other hand, drug manufacturing is the production of a controlled substance through the use of chemical processes.

What are the Penalties for Drug Cultivation & Manufacturing in Florida?

The penalties for a conviction will depend on the amount of controlled substances involved in the crime.

Cultivation penalties may include:

  • First-degree misdemeanor for possession of 25 plants or less
  • Third-degree felony for cultivating more than 25 plants
  • Two-year minimum mandatory prison sentence for possession of chemicals used for manufacturing

Manufacturing penalties may include:

  • Third-degree felony for possession of any amount of chemicals used for manufacturing
  • Two-year minimum mandatory prison sentence for possession of any amount of chemicals used for manufacturing
