Driving Under the Influence (DUI)

1. Case No: 0369XXX
   • County: Pinellas
   • Facts: Client arrested on October 4, 2008 for DUI after by the Pinellas County Sheriff’s Office. Initially, the client was stopped for speeding after being clocked on radar going 76 mph in a posted 45 mph zone. Client consented to field sobriety tests which were recorded on video. Client admitted drinking two beers. Subsequent to arrest client refused to submit to a breath test.
   • Outcome: On October 5, 2008, client hired the Morris Law Firm. The Morris Law Firm was successful in persuading the state to reduce the client’s DUI charge to Reckless Driving. In addition to avoiding a conviction for DUI the client was also able to avoid a criminal driver license suspension.


2. Case No: 008694XXX
   • County: Hillsborough
   • Facts: On December 5, 2008, client was stopped for speeding by the Florida Highway Patrol after being clocked traveling 70 mph in a posted 55 mph zone on I-275 in Tampa, Florida. Client was then taken by law enforcement to another location for testing. Client agreed to do field sobriety tests and was subsequently arrested for DUI. After his arrest, client refused to submit to a breath test.
   • Outcome: On December 10, 2008 client hired the Morris Law Firm. First, the Morris Law Firm successfully argued for invalidation of client’s administrative driver license suspension and was able to get client’s driver license fully reinstated by the Florida department of motor vehicles. Next, the Morris Law Firm successfully negotiated a reduction in client’s DUI charge to Reckless Driving. Client simply paid a fine and did not serve any probation, nor did he have a criminal suspension of his driver license.


3. Case No: 25356XX
   • County: Hillsborough
   • Facts: Client is a distinguished college professor from Ohio. On March 17, 2008 client arrived in Tampa for a vacation. As he was leaving the airport client bumped a pole at the parking attendant’s station at Tampa International Airport and unbeknownst to him security was summoned. Police for Tampa International Airport conducted a DUI investigation wherein client admitted to two glasses of wine on his flight and then agreed to and performed field sobriety exercises. Client submitted to a breath test with results of .145/.152.
   • Outcome: On March 20, 2008 client hired the Morris Law Firm. After setting the case for trial, the Morris Law Firm was successful in getting the State to reduce client’s DUI charge to a Reckless Driving charge. Client avoided a conviction for DUI which would have been very harmful to his academic career.


4. Case No: 5149XXX
   • County: Pinellas
   • Facts: On August 9, 2009 client was found passed out twenty feet from his vehicle with no other cars or people around. During an accident investigation client admitted being the driver of the vehicle. A criminal investigation was then initiated and client invoked his Miranda Rights and refused to speak further to law enforcement. Client performed field sobriety exercises on video and later submitted to a breath test with results of .136/.143. Client had a prior DUI conviction from two years earlier.
   • Outcome: On November 23, 2009 client hired attorney the Morris Law Firm. On April 21, 2010, the Morris Law Firm successfully defended client at trial arguing client was not in actual physical control of the vehicle.  Client was found Not Guilty.

False Report of a Crime

1. Case No: CTC 08-111XXMMANO
   • County: Pinellas
   • Facts: On April 19, 2008 client was involved in a minor single vehicle accident while on his motorcycle. At his girlfriend’s insistence he reported the incident to police. He had damage to his motorcycle consistent with laying it down while attempting to make a turn. Police did not believe him and arrested him for Filing a False Police Report as well as Resisting Arrest without Violence.
   • Outcome: Client hired attorney the Morris Law Firm on April 22, 2008. The Morris Law Firm set the case for trial and listed several defense witnesses on client’s behalf. The day before the scheduled trial the state filed a dismissal (Nolle Prosse) of client’s charges.

Domestic Battery

1. Case No: CTC 08-016XXMMANO
   • County: Pinellas
   • Facts: Client accepted into Navy Seals program until domestic battery arrest put his acceptance in jeopardy. Navy would no longer accept client to serve in military with a domestic violence conviction. Alleged victim was client’s wife. Client had no prior arrest record.
   • Outcome: Client hired attorney the Morris Law Firm in March 2008, and the Morris Law Firm was successful in getting the State to dismiss (Nolle Prosse) client’s domestic battery charge.


2. Case No: CTC 07-330XXMMANO
   • County: Pinellas
   • Facts: Client is a successful local business owner in Dunedin, Florida. On December 2, 2007 client along with his wife, children and friends had been out on their boat to watch the Christmas boat parade. Once back at the Dunedin Marina client and his wife began to argue. An off-duty sheriff’s deputy also at the marina that night believed he saw client strike his wife in the face and detained client while he summoned on-duty deputies. Both the client, his wife, and the client’s friend denied a battery occurred but law enforcement believed the off-duty deputy and arrested client for Domestic Battery. Client had no prior record.
   • Outcome: On July 15, 2008 client hired the Morris Law Firm. The Morris Law Firm set the case for trial and was later successful in getting the State Attorney’s Office to reduce the Domestic Battery charge to a Disorderly Conduct charge. Client simply paid a fine and avoided a battery conviction and criminal probation.


3. Case No: CTC 09-296XXMMANO
   • County: Pinellas
   • Facts: Client was a 51 year-old long time Microsoft employee with no prior criminal record. On October 13, 2009 client got into an argument with her 21 year old daughter and pulled on her daughter’s dress to stop her from leaving the house. Daughter called the police and client was subsequently arrested for Domestic Battery.
   • Outcome: On October 19, 2009 client hired the Morris Law Firm. the Morris Law Firm was successful in getting the State Attorney’s Office to drop the case and not pursue any criminal charges against the client (No Information).

Driver License Suspension

1. Case No: 004484FXX
   • County: Pinellas
   • Facts: On June 2, 2008 client received a citation for Driving While License Suspended Without Knowledge. On July 31, 2008 client appeared at the clerk’s office and paid the citation. When he did so, he unknowingly received a conviction for DWLSR. On August 18, 2008 the Florida Department of Highway Safety & Motor Vehicles issued an Order of License Revocation, notifying client his driving privileges were revoked for a period of five years.
   • Outcome: On August 22, 2008 client hired the Morris Law Firm. On August 27, 2008 the Morris Law Firm filed a Motion to Withdraw Plea and Set Aside Judgment and Sentence which was granted that same day by the Court. The client’s conviction for DWLSR was withdrawn resulting in the Florida Department of Highway Safety & Motor Vehicles vacating his five year driver license suspension and reinstating client’s driver license.

Felony Fleeing & Eluding

1. Case No: CRC 09-004XXCFANO
   • County: Pinellas
   • Facts: On January 8, 2009 client, a twenty year City of St. Petersburg employee with no prior criminal record, was arrested by St. Petersburg Police for fleeing police after a suspected drug deal. Client was adamant it was a case of mistaken identity and it was not him who had fled police.
   • Outcome: On January 20, 2009 client hired the Morris Law Firm. The Morris Law Firm was successful in establishing an alibi for client and convincing the prosecutor not to file any criminal charges against the client.

Possession of Controlled Substance

1. Case No: CRC 09-129XXCFANO
   • County: Pinellas
   • Facts: On June 21, 2009 client was out with friends in downtown St. Petersburg when he was approached and subsequently searched by St. Petersburg police. Officers found the following pills in possession of client: Klonopin, Prozac and Geodon.
   • Outcome: On July 1, 2009 client hired attorney the Morris Law Firm. The Morris Law Firm presented evidence to the State Attorney’s Office that client had a valid prescription for each of the controlled substances. The Morris Law Firm was successful in convincing the prosecutor not to file any criminal charges against the client.


2. Case No: CRC 08-259XXCFANO
   • County: Pinellas
   • Facts: In December 2008 client was arrested for Possession of Cocaine after a vehicle he was riding as a passenger in was stopped by law enforcement. The cocaine was found on the floorboard and client did not admit any knowledge of the cocaine. Client was a union steel worker who was working on construction of All Children’s Hospital and was frequently subject to random drug testing.
   • Outcome: Client hired the Morris Law Firm in December 2008. The Morris Law Firm was successful in getting the State Attorney’s Office to not file the Possession of Cocaine charge.

Aggravated Battery

1. Case No: CRC 08-027XXCFANO
   • County: Pinellas
   • Facts: Client was a paralegal at a local Clearwater law firm. In February 2008 Client found out husband was cheating on her and an altercation ensued. Husband shoved client, pulled her hair and spit in her face. In response client grabbed a knife and cut fingers on husband’s left hand. Husband called police and client was arrested for Aggravated Battery.
   • Outcome: Client hired the Morris Law Firm on February 10, 2008. The Morris Law Firm was successful in convincing the prosecutor not to file any criminal charges against the client.

Battery

1. Case No: CTC 09-015XXMMANO
   • County: Pinellas
   • Facts: Client was a police officer with the Pinellas Park Police Department. On January 18, 2009 client was off-duty and socializing with friends at Corrigan’s, a bar in downtown St. Petersburg. Client defended his brother who was involved in a physical altercation with other patrons of the bar and when St. Petersburg Police arrived on scene they arrested client for Battery.
   • Outcome: On January 18, 2009 client hired the Morris Law Firm. The Morris Law Firm interviewed numerous witnesses and provided evidence to the State Attorney’s Office that client was acting in self defense as well as defense of others. the Morris Law Firm was successful in convincing the State Attorney’s Office not to file any criminal charges against the client.


2. Case No: CTC 09-331XXMMANO
   • County: Pinellas
   • Facts: On November 16, 2009 client was arrested for Battery after an 18 year old alleged he groped her outside her clothing without her permission while on a date. Client was 77 years old. Client had no prior record. Eighteen year old’s parents wanted client prosecuted.
   • Outcome: On November 20, 2009 client hired the the Morris Law Firm. The Morris Law Firm successfully convinced the prosecutor not to file any criminal charges against the client.

Juvenile

1. Case No: CRC 10-013XXDLANO
   • County: Pinellas
   • Facts: On March 15, 2010 sixteen year old client was arrested for Battery on a Law Enforcement Officer. It was alleged client created a disturbance at school during the FCAT and when officer physically removed her from classroom client reacted by biting police officer.
   • Outcome: Client’s mother hired the Morris Law Firm on March 19, 2010. the Morris Law Firm was able to get client released from juvenile detention. The Morris Law Firm also successfully negotiated with the State Attorney’s Office to have client’s felony charge reduced to a misdemeanor Battery. Client was able to avoid a felony conviction which would have affected her status in the Pinellas County school system as well as prevented her from receiving scholarship aid for college as well as negatively impacted college admissions.
